Distance Selling Agreement

1. PARTIES

This Agreement has been executed between the parties specified below under the terms and conditions set forth herein.

A. “BUYER” (hereinafter referred to as the “BUYER” in this Agreement)

B. “SELLER” (hereinafter referred to as the “SELLER” in this Agreement)

By accepting this Agreement, the BUYER acknowledges in advance that upon confirming the order subject to this Agreement, they shall be obliged to pay the order amount and any additional fees specified such as shipping costs and taxes, and that they have been informed thereof.

2. DEFINITIONS

For the implementation and interpretation of this Agreement, the terms written below shall express the explanations written opposite them.

REGULATION: Distance Contracts Regulation (Official Gazette: 27.11.2014 / 29188),
SERVICE: Any consumer transaction other than the supply of goods, performed or promised to be performed in return for a fee or benefit,
SELLER: The company that offers goods to the consumer within the scope of its commercial or professional activities or acts on behalf of or for the account of the party offering goods,
BUYER: The real or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
SITE: The internet site belonging to the SELLER,
ORDERING PARTY: The real or legal person who requests a good or service via the SELLER’s website,
PARTIES: The SELLER and the BUYER,
AGREEMENT: This agreement concluded between the SELLER and the BUYER,
GOOD: Movable goods subject to shopping and intangible goods such as software, audio, visual, and similar products prepared for use in electronic media.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation regarding the sale and delivery of the product whose specifications and sales price are specified below, which the BUYER ordered electronically via the SELLER’s website.

The prices listed and announced on the site are sales prices. The announced prices and commitments remain valid until updated or changed. Prices announced for a limited period remain valid until the end of the specified period.

7. PRODUCT(S) SUBJECT TO THE AGREEMENT

7.1. The basic characteristics of the goods/products/services (type, quantity, brand/model, color, number) are published on the SELLER’s website. If a campaign is organized by the SELLER, the basic characteristics of the relevant product can be reviewed during the campaign period. It is valid until the campaign date.

7.2. The prices listed and announced on the site are sales prices. The announced prices and commitments remain valid until updated or changed. Prices announced for a limited period remain valid until the end of the specified period.

7.3. The total sales price of the goods or services subject to the Agreement, including all taxes, is shown below.

7.4. The shipping cost for product delivery shall be paid by the BUYER.

Invoice Delivery: The invoice shall be delivered together with the order to the billing address during delivery.

9. GENERAL PROVISIONS

9.1. The BUYER accepts, declares, and undertakes that they have read and understood the preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product subject to the Agreement on the SELLER’s website, and that they have provided the necessary confirmation electronically. The BUYER further acknowledges that they have obtained accurate and complete information regarding the address, product characteristics, prices including taxes, payment, and delivery details prior to the establishment of the distance sales contract.

9.2. Each product subject to the Agreement shall be delivered to the BUYER or to the person and/or organization at the address indicated by the BUYER within the period specified in the preliminary information section of the website, depending on the distance of the BUYER’s place of residence, provided that it does not exceed the legal period of 30 days. If the product cannot be delivered within this period, the BUYER reserves the right to terminate the Agreement.

9.3. The SELLER undertakes to deliver the product subject to the Agreement completely, in accordance with the specifications stated in the order, together with warranty certificates, user manuals, and required documents, free from defects, in compliance with legal regulations and standards, and to perform its obligations in accordance with the principles of accuracy and honesty.

9.4. The SELLER may supply a different product of equal quality and price by informing the BUYER and obtaining explicit approval before the expiration of the performance obligation period.

9.5. If the performance of the order becomes impossible, the SELLER undertakes to notify the consumer in writing within 3 days from the date it becomes aware of such situation and to refund the total amount to the BUYER within 14 days.

9.6. The BUYER accepts that the delivery obligation of the SELLER shall cease if the product price is not paid or is canceled in bank records for any reason.

9.7. If the product price is not paid to the SELLER due to unauthorized use of the BUYER’s credit card by third parties after delivery, the BUYER undertakes to return the product to the SELLER within 3 days, with shipping costs borne by the SELLER.

9.8. In cases of force majeure beyond the control of the parties, the SELLER shall notify the BUYER. The BUYER may request cancellation, replacement with an equivalent product, or postponement of delivery. Refunds shall be made in accordance with the payment method within legal periods.

9.9. The SELLER has the right to contact the BUYER via mail, email, SMS, phone, and other means for communication, marketing, notification, and other purposes.

9.10. The BUYER shall inspect the product before delivery and shall not accept damaged or defective goods. Accepted goods are deemed to be intact.

9.11. The SELLER may request verification documents if security issues regarding the credit card arise.

9.12. The BUYER declares that all information provided is accurate and undertakes to compensate any damages incurred by the SELLER.

9.13. The BUYER agrees to comply with all legal regulations while using the website.

9.14. The BUYER shall not use the website for illegal or unethical purposes.

9.15. The SELLER may provide links to third-party websites and does not guarantee their content.

9.16. Any violation shall result in legal and criminal liability for the BUYER.

10. RIGHT OF WITHDRAWAL

10.1. The BUYER may withdraw from the contract within 14 days without justification by notifying the SELLER.

10.2. To exercise the right of withdrawal, written notification must be sent within 14 days and the product must be unused. Conditions regarding invoices, return forms, packaging, refunds, and campaign adjustments apply.

11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Products prepared in line with personal requests, hygiene-sensitive products, perishable goods, opened cosmetic and personal care products, digital content, software, and similar items cannot be returned in accordance with the Regulation.

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults on payment via credit card, they accept responsibility for interest and legal costs in accordance with the agreement with the bank.

13. COMPETENT COURT

In disputes arising from this Agreement, applications may be made to Consumer Arbitration Committees or Consumer Courts within the monetary limits specified by law.

This Agreement is concluded for commercial purposes.

14. EFFECTIVENESS

By completing the payment for the order placed on the Site, the BUYER is deemed to have accepted all terms of this Agreement. The SELLER is responsible for obtaining confirmation that the Agreement has been read and accepted prior to order completion.
